We reserve the right to remove or refuse to display user-generated content at our discretion.

7. Disclaimer of Warranties

To the fullest extent permitted by law, Avidity Media, LLC and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Services, even if advised of the possibility of such damages.  

Our total liability for any claim related to your use of the Services is limited to the amount you paid, if any, to access the Services.

We reserve the right to terminate or suspend your access to the Services at our discretion, without prior notice, if you violate these Terms or engage in activities harmful to the Services or other users.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles.  

Any such arbitration shall be governed by applicable rules of National Arbitration & Mediation ("NAM") (including the Comprehensive Dispute Resolution Rules and Procedures and/or the Supplemental Rules for Mass Arbitration Filings, as applicable) ("NAM Rules"), as modified by this Section 11 (the "Arbitration Agreement,") and will be administered by NAM. (If NAM is unavailable or unwilling to do so, another arbitration provider shall be selected by the parties that will do so, or if the parties are unable to agree on an alternative administrator, by the court pursuant to 9 U.S.C. §5.) 12. Miscellaneous

Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and Avidity Media, LLC regarding the use of the Services.  

 

Severability: If any provision of these Terms is found invalid, the remaining provisions remain in full force.  

 

No Waiver: Our failure to enforce any provision of these Terms shall not be deemed a waiver of that right.
